HIV Law in Nepal 2026 — Rights, Protection and Penalty
"Nepal does not have a single standalone HIV Act. HIV-related law is dispersed across the Muluki Aparadh Sanhita (Penal Code) 2074, Sections 104-106 (infectious-disease transmission, with Sec 105 dealing specifically with HIV / Hep-B); the Constitution of Nepal 2015 Articles 16 (right to dignity), 18 (equality) and 35 (free basic health); and policy directives of the National Centre for AIDS and STD Control (NCASC) under the Ministry of Health and Population. ARV / ART is free at government centres under the Treat All policy. Intentional transmission carries up to 10 years' imprisonment + NPR 100,000 fine."
